If something hosted on SharpMD copies your work without permission, tell us and we take it down. This page follows the notice and counter-notice procedure of the United States Digital Millennium Copyright Act (DMCA). It applies to what SharpMD hosts for other people: public links, published sites at pages.sharpmd.app, shared notes and the community gallery.
Sending a notice
A notice has to come from the owner of the copyright or from someone authorized to act for them, and it has to include:
- What work was copied. If there are several, a list of them.
- Where the copy is on SharpMD: the full address of each page, link or gallery contribution, so we can find it.
- Your name, postal address, telephone number and email address.
- A statement that you believe in good faith that the use is not authorized by the owner of the copyright, by their agent or by the law.
- A statement that what the notice says is accurate and, under penalty of perjury, that you are the owner of the copyright or are authorized to act for them.
- Your signature, handwritten or electronic. Your full name typed at the end is enough.
Before sending it, check whether the use is allowed by the law, for example as a quotation or as fair use. Whoever knowingly says in a notice that something infringes when it does not can be held liable for the damages that causes.

Email is the fastest way. Put "Copyright notice" in the subject.
What happens next
- We check that the notice is complete. If something is missing we ask for it.
- If it is complete, we remove what it points to or cut access to it.
- We tell the account that had it, and send them a copy of the notice, with your name and contact details, so they can answer.
- We keep a record of the notice.
Counter-notice
If your content was taken down and you believe it was a mistake or that the work was misidentified, you can send a counter-notice to the same address. It has to include:
- What was taken down and the address where it was before.
- A statement, under penalty of perjury, that you believe in good faith that it was taken down by mistake or because the material was misidentified.
- Your name, postal address and telephone number.
- A statement that you accept the jurisdiction of the federal district court for your address or, if you live outside the United States, of any judicial district in which SharpMD can be found, and that you will accept service of process from whoever sent the notice or from their agent.
- Your signature, handwritten or electronic.
We send the counter-notice to whoever sent the original notice. If they do not tell us within 10 business days that they have gone to court to stop the use, we may put the content back between 10 and 14 business days after receiving the counter-notice.
Repeat infringers
An account that receives valid notices again and again loses what it published and, when the circumstances call for it, is closed. We look at each case: a notice that was answered with a valid counter-notice does not count against the account.
What we cannot act on
A folder protected with a password is encrypted in the browser of its owner and we cannot read it. Its notes cannot be shared or published, so they are not available to other people through SharpMD.
SharpMD is also open source software that anyone can run on a server of their own. We can only act on what is hosted at sync.sharpmd.app and pages.sharpmd.app.

Si algo alojado en SharpMD copia tu obra sin permiso, avisanos y lo bajamos. Esta página sigue el procedimiento de aviso y contranotificación de la Digital Millennium Copyright Act (DMCA) de Estados Unidos. Se aplica a lo que SharpMD aloja para otras personas: enlaces públicos, sitios publicados en pages.sharpmd.app, notas compartidas y la galería de la comunidad.
Mandar un aviso
El aviso lo tiene que mandar el titular del derecho de autor o alguien autorizado a actuar en su nombre, y tiene que traer:
- Qué obra se copió. Si son varias, la lista.
- Dónde está la copia en SharpMD: la dirección completa de cada página, enlace o aporte de la galería, para que la podamos encontrar.
- Tu nombre, domicilio postal, teléfono y correo.
- Una declaración de que creés de buena fe que ese uso no está autorizado por el titular del derecho, por su representante ni por la ley.
- Una declaración de que lo que dice el aviso es exacto y, bajo pena de perjurio, de que sos el titular del derecho o estás autorizado a actuar en su nombre.
- Tu firma, manuscrita o electrónica. Alcanza con tu nombre completo escrito al final.
Antes de mandarlo, fijate si la ley permite ese uso, por ejemplo como cita o como uso legítimo. Quien afirma en un aviso, a sabiendas, que algo infringe cuando no es así puede tener que responder por los daños que eso cause.

El correo es la vía más rápida. Poné "Copyright notice" en el asunto.
Qué pasa después
- Revisamos que el aviso esté completo. Si falta algo, lo pedimos.
- Si está completo, quitamos lo que señala o cortamos el acceso.
- Le avisamos a la cuenta que lo tenía, y le mandamos una copia del aviso, con tu nombre y tus datos de contacto, para que pueda responder.
- Guardamos un registro del aviso.
Contranotificación
Si bajaron tu contenido y creés que fue un error o que la obra se identificó mal, podés mandar una contranotificación a la misma dirección. Tiene que traer:
- Qué se bajó y la dirección en la que estaba.
- Una declaración, bajo pena de perjurio, de que creés de buena fe que se bajó por error o porque el material se identificó mal.
- Tu nombre, domicilio postal y teléfono.
- Una declaración de que aceptás la jurisdicción del tribunal federal de distrito que corresponde a tu domicilio o, si vivís fuera de Estados Unidos, la de cualquier distrito judicial en el que se pueda encontrar a SharpMD, y de que vas a aceptar las notificaciones judiciales de quien mandó el aviso o de su representante.
- Tu firma, manuscrita o electrónica.
Le mandamos la contranotificación a quien mandó el aviso original. Si dentro de los 10 días hábiles no nos avisa que fue a la justicia para frenar ese uso, podemos reponer el contenido entre 10 y 14 días hábiles después de recibida la contranotificación.
Reincidentes
Una cuenta que recibe avisos válidos una y otra vez pierde lo que publicó y, cuando las circunstancias lo justifican, se cierra. Miramos cada caso: un aviso respondido con una contranotificación válida no cuenta en contra de la cuenta.
Sobre qué no podemos actuar
Una carpeta protegida con contraseña se cifra en el navegador de su dueño y no la podemos leer. Sus notas no se pueden compartir ni publicar, así que no están al alcance de otra gente por medio de SharpMD.
SharpMD además es software de código abierto que cualquiera puede correr en un servidor propio. Solo podemos actuar sobre lo que está alojado en sync.sharpmd.app y pages.sharpmd.app.
